What Is Equitable Distribution in Divorce?
In Florida, all property acquired during the marriage is considered marital and will be divided equitably unless a party can prove that the property is nonmarital. Marital assets commonly include:
- Stocks and bonds
- Pensions and annuities
- Retirement plans, including 401(k)s
- Cars
- Houses or other real property
- Businesses
It is important to remember that debts, as well as assets, are divided equitably.
What Property Is Nonmarital?
Nonmarital property includes:
- Gifts
- Inheritances
- Assets you had before the marriage and did not commingle with marital assets
It is important to note that any nonmarital property that is commingled with marital property loses its separate value and becomes marital. For example, if you deposit your inheritance in your joint checking account, it will likely lose its nonmarital characteristic.
