The Collaborative Process
In the collaborative process, both parties sign a contract where they commit to resolving their issues amicably, without going to court. Both parties must disclose everything and the attorneys work together to find a fair and amicable resolution to their problems. If either party decides that court interaction is necessary, the collaborative lawyers must withdraw and the parties must retain new attorneys. There is a financial incentive to staying with the collaborative process once you have already committed to it.
