There are two aspects to custody in Florida:
- Parental responsibility: Florida is in favor of shared parental responsibility, which means that both parents will remain involved in the major decisions regarding the children.
- Timesharing: There is a strong presumption in Florida law that a 50/50 time sharing arrangement between the parents is in the best interests of the child. The timesharing schedule is included in a parenting plan. Your parenting plan makes clear when and for how long each parent is going to have the children.
Just because 50/50 parenting is presumed does not necessarily mean that it is always in the child's best interests. If both parents have the ability to take care of the children, and have taken care of the children in the past, the court will likely grant 50/50 custody. However, the court will look at a number of different best interests factors, including:
- Do the parents encourage the child's relationship with the other parent?
- Will the timesharing negatively disrupt the child's environment?
- Are both parents physically and mentally fit?
